General Provisions
On this Website, the company CAMELOT d.o.o., Zagreb, Frankopanska 22, OIB 29498303082 (hereinafter: Camelot) provides information society services to end users. The use of this Website by all end users is governed by these General Terms and Conditions, as well as the Privacy Policy and the Cookie Policy (“Terms”).
These Terms apply to every visit to and use of this Website, as well as to all information, content, and/or services accessible on or through this Website (“Information”).
The Terms form an integral part of all contractual relationships concluded between end users and CAMELOT as a result of using this Website and the services provided through it by CAMELOT. End users agree to the application of these Terms each time they use the services offered on this Website. Please read these Terms and the provisions contained herein carefully, and, if necessary, keep a copy for your records.
Please note that these Terms may change over time. Such changes will take effect immediately upon the publication of the updated Terms. All amendments and/or additions will be published on this Website with an indication of the date of the last modification in their header, from which date the latest version of the Terms will apply. Users are advised to regularly review the Terms for any changes. If you do not agree with the provisions of the Terms, do not use this Website or the services provided through it. Continued use of the Website by users after notification of changes will be considered acceptance of the published amendments. CAMELOT hereby excludes any liability for any damage caused to users, registered users, or third parties due to a user’s failure to familiarize themselves with such changes.
Each of these Terms provisions is considered a separate provision and, as such, has independent effect. If any individual provision or provisions of these Terms are declared invalid, the invalidity of those provisions shall not affect the remaining provisions, and the Terms shall remain in force in the remaining part.
These Terms (as well as all content on the Website) are available only in Croatian, and Croatian law shall apply. Any ambiguities or disputes arising from the use of the Website or related to its use shall first be attempted to be resolved amicably between CAMELOT and the users. If such an amicable resolution is not possible, the dispute shall be resolved by the courts of the Republic of Croatia.
End users are solely responsible for their use of the Website, as well as for maintaining the confidentiality of passwords and other user data used to access the Website. End users are solely responsible for providing and maintaining the equipment they use to access the Website.
By accepting these Terms, users declare that their actions and/or use of the Website will not restrict or prevent other users from using it and that they will not act in a manner contrary to the laws of the Republic of Croatia. This particularly applies to using the Website in a way that could harm CAMELOT and/or infringe the rights of third parties. If a user acts in such a manner, CAMELOT reserves the right to restrict or terminate the end user’s access to the Website, and the end user agrees to indemnify CAMELOT and its representatives or affiliated companies. For the purpose of enforcing this obligation, CAMELOT may monitor content on the Website and remove any content it deems contrary to the Terms or applicable Croatian laws. However, CAMELOT is not responsible to end users for the behavior of other users on the Website or for any content posted in this manner. End users are aware that during the operation of this Website, there may be periods of unavailability of content and/or services provided through it. Such unavailability may be caused by events beyond CAMELOT’s control, and CAMELOT cannot be held liable for any damage, loss, or harm suffered by end users as a result of such events. Neither CAMELOT, nor its representatives or affiliated companies, shall be liable for any damage to users and/or third parties arising from the use of or inability to use the Website. The Website may also contain third-party content, which CAMELOT does not control, does not guarantee for completeness, accuracy, or truthfulness, and is not responsible for.
This Website and its content may be protected by applicable intellectual property rights, such as copyright, trademark rights (i.e., registered marks or brands), industrial design rights, and others. The use of content available on the Website, including, for example, texts, photographs, images, drawings, logos, audio and/or video recordings, applications, any other software, protected product names, and other materials (“Materials”) is permitted solely for personal, non-commercial purposes and only in a manner consistent with the nature, subject matter, and purpose of this Website. Reproducing (including copying, downloading, or similar), distributing (for example, selling, sharing, exchanging, renting, or similar), publicly communicating (for example, publishing on other websites or social media, or by other means), or modifying (including altering, adapting, or similar) the Materials without prior written permission from CAMELOT is prohibited. Violation of this prohibition may constitute an infringement of intellectual property rights, which may result, among other things, in liability for damages and/or criminal or administrative liability.
CAMELOT processes the personal data of end users of this Website in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), as well as the Privacy Policy and Cookie Policy. Catalog
Access to the catalog is permitted only for registered users. A registered user must be an adult, i.e., a person who is at least 18 years old.
User registration is carried out by completing a web form and submitting it to CAMELOT. Upon receipt, CAMELOT will verify the submitted information within one business day and, if the user meets the registration requirements, send the user a login code for the Catalog via email. When logging in, the registered user enters their username (email address) and the code provided by CAMELOT.
Users are entitled at all times to appropriately modify their user data. CAMELOT will provide users, including during the registration process, with technical means to identify and correct incorrect data entries. However, users are obliged to verify the accuracy and correctness of the data they enter for registration purposes. CAMELOT will consider the submitted data as relevant and will fulfill its obligations under these Terms based on the provided information.
During registration on the Website, CAMELOT will ask users whether they consent to receiving notifications at the email address they provided about special sales conditions, promotions, and discounts applicable on the Website. If the user consents and until the user withdraws their consent (which they are entitled to do at any time), their email address will be used to send commercial communications from CAMELOT. All such email messages received by the user will be clearly marked as commercial communications, with clear identification of CAMELOT as the sender and instructions on how the user can unsubscribe to stop receiving such emails.
The catalog contains visual and textual representations of all cigars and other tobacco products from CAMELOT’s assortment available in CAMELOT retail stores, as well as informational data on the available quantities and prices of these products.
The catalog does not constitute an online store, as the remote sale of tobacco products is prohibited under the Act on Restricting the Use of Tobacco Products.
A registered user can send CAMELOT an inquiry about the availability and/or price of a specific tobacco product by selecting the product, specifying the desired quantity, and placing it in the so-called cart. Upon receiving the inquiry, CAMELOT will promptly send the interested customer an email with the requested information. The purchase and sale of tobacco products are conducted through CAMELOT retail stores.
